Mumbai, July 04: Narcotics control bureau has moved the High Court against lower court`s decision of framing charges for possession of 1 gm of cocaine against actor Fardeen Khan.
Fardeen was arrested by NCB in 2001 while taking delivery of cocaine from one Nasir Shaikh, a drug peddler.
While NCB wants to frame charges against him for possession of 9 gms of cocaine - seized from Nasir – special NDPS court held that charges should be framed only for 1 gm, which fardeen says he wanted to buy.
Under narcotics drugs and psychotropic substances act, possession of 1 gm of cocaine attracts six months` jail term, or option to undergo rehabilitation therapy.
For 9 gms of cocaine, punishment is upto 10 years.
NCB has challenged NDPS court`s decision in the high court.
Fardeen has not denied that he was trying to buy cocaine.
The petition will come up for hearing on July 9, said additional government pleader Purnima Kantharia.
